These Terms and Conditions ("Agreement") govern the relationship between Ganahl Real Estate Agent ("Ganahl," "we," or "our") and you ("Client," "you," or "your") in connection with the real estate services provided by Ganahl. By engaging our services, you agree to be bound by the terms and conditions outlined herein.
1. Scope of Services:
Ganahl agrees to provide real estate services, including but not limited to property buying, selling, leasing, and property management, as agreed upon between Ganahl and the Client.
2. Client's Responsibilities:
Client shall provide accurate and complete information regarding their real estate needs, preferences, and any relevant property details. Client shall promptly respond to requests for information and documentation necessary for the execution of real estate transactions.
3. Compensation:
Compensation for Ganahl's services shall be as agreed upon between Ganahl and the Client and shall be outlined in a separate written agreement. Compensation may include commissions, fees, or other agreed-upon forms of payment.
4. Confidentiality:
Both parties agree to maintain the confidentiality of all non-public information shared during the course of the engagement, including financial, personal, and property-related information.
5. Representation and Warranties:
Ganahl represents that it will act in the best interests of the Client and provide services with due diligence and care. However, Ganahl makes no warranties, either express or implied, regarding the outcome of any real estate transaction.
6. Termination:
Either party may terminate this Agreement with written notice. Termination shall not affect any obligations or liabilities that have accrued before the termination date.
7. Indemnification:
Client agrees to indemnify and hold Ganahl harmless from any claims, liabilities, damages, or expenses arising from Client's breach of this Agreement or any misrepresentation of information.
8. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Ganahl operates. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
9. Amendments:
Ganahl reserves the right to amend or modify these terms and conditions at any time. Any changes will be communicated to the Client and will become effective upon Client's continued use of Ganahl's services.
10. Entire Agreement:
This Agreement constitutes the entire understanding between Ganahl and the Client regarding the subject matter hereof and supersedes all prior agreements, understandings, and communications.
